    TERMS OF USE

    HEINZ KETCHUP UPGRADE MEANINGFUL MOMENTS COMPETITION
    OFFICIAL CONTEST RULES
    1) WELCOME:
    The HEINZ Ketchup Upgrade Meaningful Moments Competition (the “Contest”) is sponsored and administered by H.J. Heinz Company Australia Limited (ABN 87 004 200 319) of 2 Southbank Blvd, Southbank, VIC 3006, Australia (the “Sponsor”).
    2) COMPETITION PROMOTOR:
    The Contest will be promoted by HEINZ selected influencers (“Influencers”), who will post about the Contest on their Instagram account via a competition post.
    3) ENTRANT & ELIGIBILITY:
    An entrant (“Entrant” or “Entrants”) is anyone who is a legal resident of Australia, aged 18 years or older and has a valid account on https://www.instagram.com (“Instagram”) and uses the account to enter into the Contest.
    The Contest is not open to:
    (a) employees, officers and directors of the Sponsor and its parent, affiliates, subsidiaries, representatives, agents, and advertising and promotion agencies, (collectively, “Promotion Parties”); and
    (b) the immediate family members (regardless of where they live) of a person excluded under (a) or anyone domiciled with a person excluded under (a) (whether related to that person or not). For the purposes of these Official Contest Rules, “immediate family” includes husband, wife, spouse, partner, mother, father, brothers, sisters, sons, and/or daughters.
    4) CONTEST PERIOD:
    The Contest begins Monday 14 December 2020 at 9:00am AEST and ends Tuesday 15 December 2020 pm 10:00am AEST (“Contest Period”).
    5) HOW TO ENTER: NO PURCHASE NECESSARY.
    a. During the Contest Period the HEINZ influencers will post about the HEINZ Ketchup Upgrade Meaningful Moments Competition on their own Instagram account via a competition post.

    b. The post will be publicly visible to the influencers Instagram followers to enter the competition. You do not need to be following the influencer to enter the competition, but you will need find their page on Instagram and find the competition post to enter. The influencer handles that are posting about the competition include:

    @tessa.boersma
    @camellisyolmen
    @spoonful_of_sarah

    c. To enter the Contest, an Entrant must comment on the influencer’s competition post in the comments section and answer the question: ‘Tell us in 15 words or less, how Heinz Tomato Ketchup could upgrade your next occasion with family or friends?’ by Tuesday 15 December 2020 pm 10:00am AEST. All Eligible Entries will be evaluated based on their creativity, originality and humour.

    d. Once commented, the Entrant will have entered into the Contest. Entries on the Instagram post must be publicly viewable by the Sponsor and remain posted until the end of the Contest Period, otherwise the Entry will be deemed ineligible.

    e. Entrants are only allowed one entry in to the competition (one comment to the competition Instagram post (1) “Entry”) across all influencers. See Rule 7: Entry Limits.

    If submitting/uploading Entry via a mobile device, standard data rates may apply. Entrants should check their service carrier plan for more information regarding rates and fees. Entries may only be submitted by the authorized account holder of the Social Media Platform. Use (or attempted use) of any automated macro, script, robotic, or other system(s) or program(s) to enter or otherwise participate in or disrupt this Contest is prohibited and is considered grounds for disqualification from this Contest.
    6.1) ENTRY CONDITIONS:
    Each Entry must: (1) be original; (2) be created for the purposes of this Contest; (3) have not been previously published, used commercially, submitted prior to this Contest or during this Contest to another Contest, competition or promotion or won any other prize/award; (4) not defame, infringe or violate the rights of any third party (including, without limitation, copyright or other intellectual property rights of any other party); (5) be appropriate for the Contest and all ages, in “good taste”, in keeping with Sponsor’s image and be suitable for publication (e.g. must not be obscene or indecent or degrade, harass or intimidate an individual or group of individuals on the basis of any impermissible classification, including without limitation, religion, gender, sexual orientation, race, color, creed, ethnicity, national origin, age, disability, marital status or military status), as determined by Sponsor in its sole and absolute discretion; and (6) not contain any commercial content that promotes any product or service other than those offered by Sponsor. Sponsor reserves the right, in its sole and absolute discretion, to reject, modify, edit or remove any Entry and judge it void or disqualify it and you at any time, without notice to you, that Sponsor deems, in its sole and absolute discretion, not to be in keeping with the Official Contest Rules.
    7) ENTRY LIMITS:
    Entrants are only allowed one entry in to the competition (one comment to the competition Instagram post (1) “Entry”) across all influencers. This means if an entrant has commented on multiple influencers (2x or more influencers) competition posts, all entries of that entrant will be deemed ineligible.

    If an entrant comments multiple times on the same influencers post (1x influencer), the first entry only will be eligible, as best determined by the ‘Sponsor’ based on the time and day details available on Instagram.

    Multiple entrants within the same household may enter into the competition, however prizes are restricted to one prize per household as per Rule 13: Prize Conditions.
    8) HOW TO WIN:
    This is a game of skill, and chance plays no role in the judging of the winners. All eligible Entries received during the Contest Period will be evaluated by a judging panel (the “Panel”) comprised of representatives from the Sponsor. Judging by the Panel will take place between 10:00am Tuesday 15 December 2020 and 2:00pm Tuesday 15 December 2020 (“Judging Period”) in Melbourne, Australia. For judging purposes, all eligible Entries will be evaluated based on their creativity, originality and humour. All entries with be allocated a score out of 10 based on these criteria.

    The Judging Panel will select the top five (5) scoring Entries (“Potential Prize Winners”).

    9) HOW TO CLAIM A PRIZE:
    Potential Prize Winners will be notified via the messaging feature on Instagram, starting Tuesday 15 December 2020 at 2:00pm AEST (“Notification”). If a Potential Prize Winner cannot be contacted within one (1) business day of Tuesday 15 November 2020, at Sponsor’s sole discretion, another Entry may be selected.

    Upon Notification, Potential Prize Winners will have one (1) business day to provide their name, daytime phone number, email address, postal address and age in order to accept the Prize (defined below) as awarded (“Prize Winner”).

    The Sponsor, in its sole discretion, reserves the right to select another Entrant should a selected Entrant fail to do the aforementioned, or if found ineligible for any reason.
    10) DELIVERY:
    Delivery of Prizes is expected to occur between Thursday 17 December 2020 and Friday 31 December 2020, by the “Sponsors” chosen restaurant/café preferred method of delivery.

    Due to COVID, further delays on prize deliveries may incur.
    11) ODDS:
    The odds of winning a Prize depend upon the eligible Entry submitted by an entrant during the Contest Period and application of the judging criteria.
    12) PRIZES/APPROXIMATE RETAIL VALUES:
    There are four (4) prizes available to be won, each consisting of: Three (3) 500ml bottles of Heinz? Tomato ketchup, one (1) custom hamper by the “Sponsors” chosen restaurant/café, to the approximate retail value of $210.00 each, or $1,048.00 in total for all prizes.
    13) PRIZE CONDITIONS:
    Prizes are restricted to one prize per household.
    14) LIMITATION OF LIABILITY:
    By entering Contest, Entrants accept and agree to these Official Contest Rules and the decisions of Sponsor, which shall be final in all matters. Releasees (as defined below) are not responsible for lost or late Entries, or the Declaration, or for any typographical, or other error in the printing of the offer, failure of the Instagram, administration of the Contest, or announcement of any Prize, or for technical, hardware, or software malfunctions, computer virus, bugs, tampering, unauthorized intervention, fraud, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this Contest, or by any human error which may occur in the processing of the Entries in this Contest, or any other cause beyond the reasonable control of Sponsor that interferes with the proper conduct of the Contest as contemplated by these Official Contest Rules.

    The Sponsor extends absolutely no representations or warranties in respect of a Prize and accept no liability arising in respect of such Prize or in the use thereof.
    15) PRIVACY:
    The Sponsor respects the Entrants’ right to privacy. Personal information collected from Entrants (including but not limited to names, age, mailing addresses, telephone numbers, and email addresses) will only be used for the purpose of administering this Contest and conducting publicity about this Contest. By entering this Contest, Entrants consent to Sponsors’ and Influencers collection, use, and disclosure of their personal information for these purposes.     16) INSTAGRAM:
    This Contest is in no way sponsored, endorsed or administered by, or associated with Instagram. The owners and operators of Instagram are completely released from all liability by each entrant in this Contest. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not to Instagram.

    OFFICIAL CONTEST RULES

    a. The competition will be launched via a notification post on HEINZ Facebook account on Saturday 12th December 9am.

    b. During the Contest Period, the HEINZ Facebook page will post about the HEINZ 12 Days of Heinzmas via one (1) daily competition post across Facebook for the twelve (12) days of the competition period.

    c. The post will be publicly visible across HEINZ Facebook account for people to enter the competition. You do not need to be following the HEINZ Facebook account to enter the competition.

    d. To enter the Contest, an Entrant will have until Thursday 24 December 2020 10:00pm AEST to comment on any of the twelve (12) daily competition posts on HEINZ Facebook page in the comments section and answer the question: ‘In 25 words or less, what is your favourite festive Heinzmas meal?’ All Eligible Entries will be evaluated based on their creativity, originality and humour. Entries will not be valid if commented on after Thursday 24 December 2020 10:00pm AEST.

    e. Once commented, the Entrant will have entered into the Contest. Entries on the HEINZ Facebook posts must be publicly viewable by the Sponsor and remain posted until the end of the Contest Period, otherwise the Entry will be deemed ineligible.

    f. Entrants are only allowed one (1) daily entry into the competition (one comment to the competition post on Facebook post (1) “Entry”). See Rule 7: Entry Limits.

    8) HOW TO WIN:
    This is a game of skill, and chance plays no role in the judging of the winners. The top seventy-three (73) entries will be allocated a score one (1) to seventy-three (73) based on these criteria.

    The Judging Panel will select the top seventy-three (73) scoring Entries (“Potential Prize Winners”). The winners will be ranked from one (1) to seventy-three (73) based on the evaluation criteria (one (1) being the highest score and seventy-three (73) the lowest) and will be eligible for the below:

    a) Rank 1 will be eligible to receive one (1) Weber Genesis II S-355 Gas Barbecue (LPG) to the recommended retail value of $2,149.00; plus one (1) Weber Rotisserie to the recommended retail value of $199.95; plus one (1) Weber Premium Barbecue Cover to the recommended retail value of $134.95

    b) Rank 2-13: will be eligible to receive one (1) Weber Baby Q Premium Gas Barbecue in Red (LPG) to the recommended retail value of $349.00, plus one (1) Weber Premium Barbecue Cover to the recommended retail value of $29.95.

    c) Rank 14-73: will be eligible to receive one (1) Heinz branded 6L red cooler bag to the recommended retail value of $25.00.
    9) HOW TO CLAIM A PRIZE:
    Potential Prize Winners will be notified via the messaging feature on Facebook, starting Friday 8th January 2021 at 2:00pm AEST (“Notification”). If a Potential Prize Winner cannot be contacted within five (5) business days of Friday 8th January 2021, at Sponsor’s sole discretion, another Entry may be selected.
